On 3 December 2009 the Belgian Parliament adopted the new Belgian Gaming Act, entered into force on 1 January 2011 even though its implementing provisions (Royal Decrees of execution) had not been adopted given that the Belgian government was outgoing.
Further to the new Gaming Act, online gambling licenses may only be issued to land-based operators already operating in Belgium under an A, B or F1 license (the so-called “offline requirement”). GamblingCompliance: Bwin.Party Shrugs Off German Court Defeat

Bwin.Party has brushed off a ruling from Germany’s highest administrative court that internet sports betting is illegal and pointed instead to fast-moving political events set to come to a head next week.

The German Federal Administrative Court, based in Leipzig, yesterday upheld the legality of Germany’s ban on internet sports betting as it handed victory to Bavaria’s authorities over online betting giant Bwin.

It also neutered the firm’s East German betting licence, which Bwin had argued entitled it to offer nationwide sports betting, judging instead that it is only valid for land-based betting in the region of Saxony.

But Bwin.Party was joined by local lawyers yesterday in arguing that the ruling has already been overtaken by political events. … Continue Reading
