Follow a course on the Regulation of Cross-Border Online Gambling?

The Centre for Commercial Law Studies of Queen Mary University of London runs programmes, including a LLM, in Computer and Communications Law by distance learning. For the autumn term of 2016/2017 Dr Alan Littler will convene a course on the Regulation of Cross-Border Online Gambling. Individual courses from the programme can be taken on an ad hoc basis.

Latest German court ruling offers protection to online gamblers

Germany’s controversial State Treaty on Gambling has suffered yet another blow after a court ruled that authorities may not prosecute players for gambling on unlicensed sites.

Last week’s decision overturns the original ruling by the Munich Regional Criminal Court, which had said that Section 285 of the German Criminal Code (Strafgesetzbuch) could be interpreted to mean that no individual may be involved in illegal public gambling.This was seen to set a precedent under which online casino and poker players could be prosecuted, as the State Treaty prohibits these activities. … Continue Reading

WOGLR: Amsterdam Court of Appeal deems poker game of chance

A recent decision by the Court of Appeal of Amsterdam has overturned a January 2014 District Court ruling, finding that poker is a game chance under the Dutch Betting and Gaming Act 1964. This seems somewhat controversial, particularly given previous case law on the matter. Dutch government reconfirms classification binary options as a financial instrument

On 4 April 2016, the Minister of Finance (also on behalf of the State Secretary of Secretary and Justice) published its answers to parliamentary questions on the qualification of binary options as a financial instrument. MPs of the Christian Democratic Party (“CDA”)  again questioned whether binary options should not be qualified and regulated as games of chance rather than financial instruments. In its response the Minister referred to its previous answers of 30 October 2015 in which he already held that binary options are qualified as financial instruments in accordance with the European Markets in Financial Instruments Directive (MiFID). As such the Netherlands Authority of Financial Markets (“AFM”) is responsible for supervision of binary options, according to the Minister of Finance. … Continue Reading
